Lubinets explained that employees of the Territorial Defense Forces do not have the right to do during mobilization.
Ombudsman Dmitry Lubinets explained the limits of the powers of employees of the Territorial Defense Forces (TDC) during mobilization. They can check military registration documents, issue summonses, and refer individuals to military medical commissions (VLC), but they do not have the right to use force, threaten, confiscate phones or documents, or illegally detain a person. The right to deferment and health status must be taken into account.
Dmytro Lubinets, the representative of the Verkhovna Rada on human rights, explained which actions of employees of territorial recruitment and social support centers during mobilization are legal, and which are unacceptable.
According to him, employees of the territorial recruitment center have the right to verify military registration documents, issue summonses and other documents in accordance with the law, direct conscripts to a military medical commission, and maintain military registration.
At the same time, the ombudsman emphasized that employees of the recruitment center do not have the right to use physical force or threats, to take a person's phone, documents, or personal belongings, or to detain them in the recruitment center without legal grounds.
Separately, Lubinets pointed out that during mobilization, it is impossible to ignore a person's right to deferment and consideration of their health condition. According to him, he has repeatedly emphasized cases of rights violations during mobilization and noted that the new Commander-in-Chief is also responsible for such violations.
